HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION NO.30092 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking to issue writ of mandamus declaring the action of the respondents in constructing a temple in the playground of the school as illegal and arbitrary.

Heard learned counsel for the petitioner, learned Government Pleader for Revenue and Education representing respondents 1 to 5 and Mr.G.Seshadri, learned standing counsel for Panchayatraj, representing 6th respondent. 3.

The petitioner is a retired Head Master. The case of the petitioner is that somebody is constructing temple in the playground of Zilla Parishad High School situated at Ooliapalem, Pakala, Singarayakonda Mandal, Prakasam District. The petitioner has not mentioned the names of the persons, who are making construction.

A perusal of the record reveals that the petitioner submitted a representation to the 2nd respondent on 29-08-2016. For one reason or the other, the 2nd respondent has not passed appropriate order on the representation of the petitioner.

Learned counsel for the respondents submitted that the petitioner has not filed any acknowledgment to prove that he submitted a representation to the 2nd respondent.

At the time of arguments, the only relief sought for by the petitioner is to direct the 2nd respondent to dispose of the representation of the petitioner as expeditiously as possible. 7.

Learned Government Pleader and the learned standing counsel for the 6th respondent also consented for the same. 8.

In view of submissions made by both counsel, this Court is not inclined to go into the merits of the case. 9.

Having regard to the facts and circumstances of the case, the 2nd respondent is directed to dispose of the representation of the petitioner, dated 29-08-2016 as expeditiously as possible preferably within a period of six weeks from the date of receipt of a copy of this order.

Accordingly, the writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
