The petitioner is a practicing advocate. She got admission into 4th respondent-Sultan Ul Uloom Law College, which is affiliated to Osmania University, for the year 2014-2016 in LL.M (Corporate Law). On 19.02.2015 the petitioner brought cell phone into the exam hall while she was writing 1st paper, viz., Jurispridence and theories of law, since there were no proper arrangements for its safe custody. During the examination, the invigilators came and booked some students, who were indulging in malpractice, and on checking they noticed that the petitioner was in possession of cell phone and seized the same. The petitioner states that she did not indulge in malpractice and that previously she passed LL.B examination with distinction.
She filed the present writ petition challenging the action of the respondents 1 and 2 in seizing and withholding her cell phone and hall ticket with them. A counter affidavit is filed on behalf of respondents 1 and 2 stating that contrary to the regulations under ordinance No.VII relating to conduct of Examinations, the petitioner carried cell phone into the exam hall and hence a case was booked against her for malpractice. The Malpractice Committee Meeting was held in the month of March, 2015 but no final orders have been passed so far. In the circumstances, I deem it appropriate to direct respondents 1 and 2 to complete the enquiry against the petitioner, if any, and pass final orders thereon pursuant to the seizure of cell phone on 19.02.2015, within a week from the date of receipt of a copy of this order.
