THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR Writ Petition No.2478 of 2015 Order: (per the Hon'ble the Chief Justice Sri Kalyan Jyoti Sengupta) After hearing the learned counsel for the parties, we feel that this Court at the most, at this stage, can pass the following orders.

The petitioner's vehicle has been seized on various grounds. One of them is for non-payment of alleged dues of tax. However, such tax dues is disputed by the petitioner. The petitioner will be free to make a representation taking all points, and the second respondent shall consider the same after giving personal hearing to the petitioner, and pass a speaking order within a period of 15 days from the date of communication of this order. Such representation shall be made within five days from the date of receipt of this order. Failing which the issue will be closed chapter. In the meantime, in the event, the petitioner deposits the alleged dues in full, then the vehicle shall be released forthwith provided the petitioner produces documents, namely, R.C., Permit, Driving Licence, Form 38, CPUCC etc. Such deposit will

be without prejudice to the rights and contentions of the petitioner. In the event, the petitioner could satisfy the second respondent that there are no dues or part dues found, the deposit so to be made to be refunded either in full or in part, in case of part liability.
