THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.41542 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to declare the action of the respondent police in not registering the case against the culprits basing on the complaint of the petitioner, dated 15.11.2016, and not taking any action against the culprits, as illegal and arbitrary, and consequently, direct the respondent police to register a crime and investigate the same basing on the complaint of the petitioner.

Heard and perused the material available on record. The main grievance of the petitioner is that he lodged a complaint on 15.11.2016, before the Superintendent of Police, Srikakulam District - 2nd respondent, against the persons, who trespassed into his land and threatened to kill him and his brother, stating that they belong to CPM party, but the respondent police have not taken action on the said complaint.

Considering the grievance of the petitioner, the respondent 2 to 4 are directed to register a case basing on the compliant, dated 15.11.2016, lodged by the petitioner, if the said complaint discloses any cognizable offence and investigate into the same and file a final report if any. If the petitioner is aggrieved over the action of the respondents 2 to 4, he is at liberty to approach the superior officer of the 2nd respondent and also to approach the concerned Court by invoking provision under Section 200 Cr.P.C.

Accordingly, the writ petition is disposed of. No order as to costs. Pending Miscellaneous Petitions, if any, shall stand closed. ______________ RAJA ELANGO, J November 30, 2016.
