HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.38342 OF 2018 ORDER :

The case of the petitioners is that they are the absolute owners and possessors of the land in Survey No.19, to an extent of Ac.17.38 guntas, situated at Tikkepally Village, Bejjur Mandal of Asifabad District. The 1st petitioner purchased land to an extent of Ac.5.00 out of total extent of land i.e. Ac.17.38 guntas and the 2nd petitioner purchased the balance land to an extent of Ac.12.38 guntas from one Ch.Poshalu @ Posulu through registered sale deeds dated 21.05.2016. It is stated that petitioners' vendor's name was mutated in the pahani and the respondent authorities have also issued pass book in his favour. After purchase of the aforesaid property the petitioners have been requesting the 4th respondent for mutation of their names in the revenue records and also submitted representation to the 2nd respondent on 21.11.

The petitioner also approached the 3rd respondent who in turn directed the 4th respondent on 11.05.2017 to submit the report immediately, and thereafter, the petitioners again submitted representation to the 4th respondent on 03.07.2017. But the 4th respondent is postponing the same. Aggrieved by the inaction of the 4th respondent in updating the revenue records and in issuing new passbooks and title deeds, present writ petition is filed.

Heard learned counsel for the petitioners and learned Assistant Government Pleader for Revenue.

Since the representation submitted by the petitioners is pending before the 4th respondent, it is for the 4th respondent to consider the same and take action.

In view of the same, the writ petition is disposed of directing the 4th respondent to consider the representation of the petitioners and pass orders, in accordance with law, within a period of three months from the date of receipt of a copy of this order. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 24.10.2018 t k.
