HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 38517 of 2018 ORDER:

1) Heard learned counsel for the petitioner and learned Standing Counsel for Greater Hyderabad Metropolitan Development Authority (HMDA).

2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent No.2 to 5 in not registering the sale deed in favour of the petitioner transferring the residential house MIG H.No.8-8-239, situated at Madhuban Residential Complex, Kattedan, Hyderabad, even though respondent No.2 received entire sale consideration by 03.04.2006 by considering the representation submitted by the petitioner dated 08.08.2018, which is received and acknowledged on 13.08.2018, as illegal and arbitrary.

3) Though various grounds are raised, learned counsel for the petitioner restricts his prayer seeking a direction to the respondents to deal with the representation dated 08.08.2018 made by the petitioner, which was acknowledged on 13.08.2018, seeking execution of registered sale deed in favour of the petitioner in respect of the residential house bearing No.8-8-239, situated at Madhuban Residential Complex, Kattedan, Hyderabad, in accordance with law, at the earliest.

4) Learned Standing Counsel would submit that if the application is made and if it is still pending consideration, the authorities would deal with the same, in accordance with law.

5) Having regard to the above, the writ petition is disposed of directing the authorities to deal with the representation dated 08.08.2018 made by the petitioner, which was received in the office on 13.08.2018, seeking execution of registered sale deed in favour of the petitioner, in respect of the residential house referred to above, in accordance with law, after hearing all the concerned, as early as possible.
