HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.29365 of 2015 ORDER:
Heard Sri PVV Satyanarayana, learned counsel appearing for the petitioner, learned Government Pleader for Panchayat Raj, Sri MSR Chandramurthy, learned special counsel for the 2nd respondents and Sri Cheemalapati Ravi, learned standing counsel for R.3.
2. The petitioner was appointed as a Field Assistant of Vemavaram Gram Panchayat, Gundlavalleru Mandal, Krishna District on 20.01.2009. Levelling certain charges, the petitioner was kept under suspension vide impugned proceedings dated 06.07.2015 of the 2nd respondent, proposing to conduct enquiry basing on the complaint of the Gram Panchayat Sarpanch and called for the explanation from him.
3. Learned counsel appearing for the petitioner submits that basing on a false complaint, the 2nd respondent passed impugned proceedings, without applying mind to the facts in a proper way. On the other hand, learned Special counsel would submit that since the order impugned is an order of suspension pending enquiry, the same does not require any interference in the present writ petition, as the enquiry is proposed to be held.

Considering the submissions made on either side, without going into the merits of the case, the 2nd respondent-Project director is directed to conduct enquiry duly considering the explanation submitted by the petitioner and pass appropriate orders, in accordance with law, within a period of eight (8) weeks from the date of receipt of a copy of this order, failing which, the order of suspension shall stand revoked.
5. The writ petition is accordingly disposed of. Miscellaneous petitions, if any, in this writ petition, shall stand closed. No order as to costs.
