THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION NO. 34413 OF 2013 ORDER:

Heard the learned counsel for the petitioners as well as the learned Government Pleader appearing for respondent Nos. 1 to 3. 2.

The prayer sought in the Writ Petition is as under: " ...to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of respondents 2 and 3 in not undertaking investigation in FIR No. 116/ 2013 and not recording appropriate penal provisions of law as against 4th respondent by citing him as offender/ accused person as illegal, irregular, irrational, amounts to non discharge of legal obligation conferred on them under the provisions of Code of Criminal Procedure, 1973 and offends Article 14 of Constitution of India and consequently direct the respondents to trace out 1st petitioner's wife by name Adabala Varalakshmi and prosecute 4th respondent for appropriate offences and penal provisions of law." 3.

During the course of hearing, learned Government Pleader placed on record, the orders passed by the Sub-Divisional Police Officer, Jangareddigudem vide C.No.20/ SDPO-J/ Refer/ 2015 dated 31.1.2015. A perusal of the said proceedings would indicate that after investigation, action was dropped on the requisition of the SI of Police, Dharmajigudem P.S.

Having regard to the said fact, this court is of the opinion that no further orders are required in the Writ petition. 5.

Accordingly, the Writ petition is dismissed.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
