COMMON JUDGMENT:

A.S.No.551 of 2014 arises out of judgment and decree, dated 17.07.2014, in O.S.No.58 of 2009 on the file of learned III Additional District Judge (Fast Tract Court), Anantapur. The appellant filed A.S.M.P.No.801 of 2015 seeking permission to withdraw the appeal. In the affidavit filed in support of this application, the appellant stated that he addressed a letter, dated 15.04.2015, to his counsel instructing him to withdraw the appeal and he has accordingly prayed for permission to withdraw the appeal. At the hearing, Sri S.Md.Haneef, learned counsel for the appellant, has reiterated the aforesaid prayer. A.S.M.P.No.801 of 2015 is accordingly allowed. Consequently, A.S.No.551 of 2014 is dismissed as withdrawn. As a sequel to dismissal of the appeal, A.S.M.P.No.1998 of 2014 filed by the appellant for ad interim injunction is dismissed as infructuous.
