The Hon'ble Sri Justice C.V.Nagarjuna Reddy Writ Petition No.40085 of 2015 Date: 17.12.2015 Between:
Bangari Prakash and 2 others ..
Petitioners and The State of Telangana rep. by its Prl.Secretary Municipal Administration & Urban Development Hyderabad and 2 others.
.. Respondents Counsel for the petitioners: Mr.K.S.Murthy Counsel for respondent No.1: AGP for Municipal Administration The Court made the following:
O r d e r :
This Writ Petition is filed for a Mandamus to declare the action of the respondents, in not showing the voters belonging to Mehdipatnam - 70th ward, as per the delimitation, as voters of Mehdipatnam Ward, and showing them as voters in other wards, as illegal and unconstitutional. The petitioners sought for a consequential direction to the respondents to rearrange the voters' list based upon the delimitation process of 2015, which relied upon census 2011, determine the percentage of B.C.Voters and then, finalise the seat reservation to the said category.
At the hearing Mr.K.S.Murthy, learned Counsel for the petitioners, submitted that respondent No.2 has passed an appropriate order on the objections raised by the petitioners relating to preparation of voters list for Mehdipatnam - 70th Ward and that feeling aggrieved by the said order, the petitioners have filed an appeal before the State Election Commission.
In the light of these subsequent events, no further adjudication of the Writ Petition is necessary.
The Writ Petition is, accordingly, disposed of with liberty to the petitioner to pursue the appeal and other legal remedies, if any, available to them in law.
As a sequel to disposal of the Writ Petition, WPMP.No.51747 of 2015, filed by the petitioners for interim relief, is disposed of as infructuous. ______________________ (C.V.Nagarjuna Reddy, J) Dt: 17th December, 2015 lur
