THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.35714 of 2015 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for Revenue.
In this writ petition, petitioner is aggrieved by the inaction of the respondents in conducting survey and demarcation of her land admeasuring Acs.3.30 guntas covered by Survey No.129/3 situated at Vattinagulapalli Village, Rajendranagar Mandal, Ranga Reddy District.
The instructions of the learned Government Pleader for Revenue show that the aforesaid land was assigned to one E.Ramaiah, Son of Venkaiah, under file No.D/2354/2002 and since there was alienation by the said assignee, under the provisions of the Andhra Pradesh Assigned Lands (Prohibition of Transfers) Act, 1977, the said land is stated to have been resumed to Government vide proceedings, dated 06.12.2005.
The petitioner, however, states that she is not aware of the said resumption order and would take appropriate steps to question the said proceedings in accordance with law.
In view of resumption of the land in question as above, nothing further survives in the writ petition.
The writ petition is accordingly dismissed. However, the petitioner is at liberty to take appropriate steps, if cause of action survives and law permits.
Miscellaneous Petitions, if any pending in this Writ Petition shall stand closed. No order as to costs.
