THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.10243 OF 2015 ORDER: (per the Hon'ble The Chief Justice Sri Kalyan Jyoti Sengupta) After hearing the learned counsel for the parties, we dispose of the writ petition as no counter affidavit is sought to be filed in this matter by the respondents. The Commissioner of the respondent Municipality shall issue notice to the petitioner for giving personal hearing to her in connection with the representation made by her on 7.10.2014 against the demand notice issued by the Municipality. After hearing the petitioner the Commissioner shall pass a speaking order in the matter. The

demand notice impugned herein will abide by the result of such decision so to be taken. The entire exercise shall be completed within a period of six weeks from the date of receipt of a copy of this order. Pending such decision, no coercive measures shall be taken against the petitioner for recovery of the property tax. The writ petition is accordingly disposed of. Pending miscellaneous petitions, if any, shall stand closed. There will be no order as to costs.
