The present writ petition is filed by the petitioner under Article 226 of the Constitution of India, seeking a direction to respondents 2 and 3 to take immediate action for removal of the bunks illegally erected in road margin and in front of the shop of the petitioner. 2.
Heard and perused the material available on record. 3.
It is stated in the affidavit that one N. Srinivasulu, former MPP tried to grab away the property of the petitioner and he encouraged respondents Nos.4 and 5 to erect a tiffin bunk as well as Fast Food Bunk before the shops of the petitioner causing obstruction to ingress and egress to the shops of the petitioner. Then, the petitioner lodged a complaint before the 3rd respondent on 20.9.2016 and he also made a representation to the 2nd respondent. But no action was taken. 4.
Considering the facts and circumstances of the case and the grievance of the petitioner, the Writ Petition is disposed of with the following direction:
"Respondents 2 and 3 are directed to register the complaint made by the petitioner on 17.10.2016, if it discloses any cognizable offence. If the above respondents fail to register the complaint, the petitioner is at liberty to approach the higher officials and to avail the remedies that are available under law."
No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
