M/S.Dynamic Env.Solutions Private Limited v. Union Of India
THE HON'BLE SRI JUSTI CE A.V.SESHA SAI W.P.Nos.38332 of 2018 O R D E R:
Heard the learned counsel for the petitioner and Sri K.Lakshman, learned Assistant Solicitor General for the respondents. 2.
The grievance of the petitioner herein in the present writ petition is that in an arbitrary manner the second respondent cancelled the earlier tenders and floated new tenders. It is further submitted by the learned counsel that pointing out the illegality in the said action, petitioner herein submitted representations on 08.10.2018, 16.10.2018 and 22.10.2018 and without taking any action on the said representations, the second respondent authorities are proceeding with the process of finalisation of the tenders pursuant to the second tender notification. Ultimately, a request is made by the learned counsel for the petitioner to direct the respondents to consider the representations before proceeding further with the process of finalisation of tenders pursuant to the second tender notification. 3.
Having heard the learned counsel for the petitioner and the learned Assistant Solicitor General and as the petitioner herein pointed out a number of aspects in the said representations, this Court deems it appropriate to dispose of the writ petition with a direction to the second respondent to verify the representations dated 08.10.2018, 16.10.2018 and 22.10.2018 and pass appropriate orders/take appropriate action, strictly in accordance with law, as expeditiously as possible, preferably within a period of two weeks from the date of receipt of this order. Till the said course of action is completed, final action pursuant to the second tender notification shall be deferred. 4.
Accordingly, the writ petition is disposed of. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
