ORDER:

Heard.

2. Petitioner, working as driver with the respondent corporation, was put off duty by order of the Depot Manager dated 30.10.2014 in view of the adverse breath analyzer test showing that the petitioner had consumed the alcohol beyond the permissible limit. On the same day, petitioner has also been given a charge sheet requiring him to submit explanation. The said disciplinary enquiry is pending. Petitioner has, however, questioned the order putting him off duty as well as the issuance of the charge sheet.

3. However, similar contentions, as raised by the petitioner with reference to circular of the respondent corporation, were already considered by this Court and rejected in WP.No.3627 of 2015 dated 19.02.2015. In view of that, both the said orders, which are impugned herein, do not require any interference. So far as conducting of disciplinary enquiry is concerned, the same, undoubtedly, has to be conducted expeditiously. Hence, respondents are directed to ensure that the disciplinary enquiry is completed as expeditiously as possible, preferably, within a period of two (2) months from today.

The writ petition is disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs. _____________________ VILAS V. AFZULPURKAR, J February 24, 2015 DSK
