HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.38352 OF 2018 ORDER :

The only grievance in the writ petition is the appeal filed by the unofficial respondents before the 3rd respondent is not maintainable, as 3rd respondent has no power to cancel the pattedar pass books and title deeds issued to the petitioner. On the other hand learned Assistant Government Pleader for Revenue submits that the appeal is not only regarding issuance of pattedar pass books and title deeds but also regarding amendment of record of rights. It is to be seen that the petitioner relies on the Judgment rendered by this Court in Ratnamma v. Revenue Divisional Officer, Ananthapur District [2015 (5) ALT 228 (D.B)].

In this case it is to be seen that the appeal is filed by the unofficial respondents not only regarding issuance and cancellation of pattadar pass books and title deeds to the petitioners but also regarding amendment of record of rights, More so, petitioners can raise all these objections before the 3rd respondent i.e. appellate authority.

In view of the same, the writ petition is disposed of granting liberty to the petitioners to raise all these objections before the 3rd respondent and the 3rd respondent is obligated to consider the same. No order as to costs.
