THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.44189 of 2016 ORDER:
Heard Sri V.Mallik for petitioners and Assistant Government Pleader (Fisheries) for respondents.
The petitioners complain inaction against respondents in disposing of representation dated 10-11-2016 as illegal, arbitrary and unconstitutional.
The request of petitioners is to become members of the 4th respondent Society.
The Assistant Government Pleader (Fisheries) requests the Court to place on record the written instructions dated 05-12-2016. The operative portion reads thus:- " In this connection, it is to submit that as per the Procedure for getting admission into a Society, they have to submit applications FORM J to the concerned Fishermen Cooperative Society. After verification and feasibility of admission of new members, the Society will put a requisition to conduct skill test to the applicants to test their fishing skill so as to admit them into Society.
In this case, the petitioners have filed a simple representation for admission into the Society. This representation was examined and informed them vide this office letter dated 05-12-2016, to apply as per above procedure along with their Caste, Income and Aadhar Card etc ., DOCUMENTS as per the norms."
From the above, it is clear that if the representation is made by the petitioners in Form-J, the respondents are prepared to consider and take a decision.
Having regard to the written instructions, the writ petition is disposed of by this order.
The petitioners are given liberty to apply for membership, as noted above, by enclosing a copy of this order, within four weeks from today. On such application being made by the petitioners, respondents 3 and 4 are directed to take a decision within six weeks thereafter and communicate the same to petitioners.
The writ petition is disposed of accordingly. No order as to costs.
