This Criminal Petition is filed under Section 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/A4 seeking his enlargement on bail in connection with Crime No.162 of 2025 of Kuknoorpally Police Station, Siddipet District. The offences alleged against the petitioner are under Sections 303(2), 317(2) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 (BNS).

The brief facts of the case are that, on 02.08.2025, the defacto complainant lodged a report with the police stating that he regularly goes for agricultural work in his JCB vehicle, which he usually parks beside the house of Komati Chandramouli. On 29.07.2025, he parked the vehicle in the same place. However, on the following day, i.e., 30.07.2025, he noticed that the battery cover (Jali) of the JCB had been broken. Upon checking, he found that the battery was missing. It was also discovered that the batteries of two other vehicles belonging to different persons were likewise stolen during the same night. Thus, unknown persons had committed theft of the JCB batteries. Based on the said complaint, a case was registered and investigation was taken up.

Heard Sri G. Santosh Pawan Babu, learned counsel appearing for the petitioner and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for the respondentState. 4.
The contention of learned counsel for the petitioner is that the petitioner is innocent of the allegations leveled against him and that the petitioner has been working under Accused No.5, who has already been granted bail. He further submitted that
- 3 - the petitioner was arrested on 27.11.2025, and that the material part of the investigation has already been completed. Therefore, he prayed this Court to grant bail to the petitioner. 5.
On the other hand, the learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner, contending that the petitioner is a habitual offender and that as many as eight crimes are pending against him. He further submitted that the allegations are grave in nature and that the investigation is still in progress. Therefore, he prayed the Court to dismiss the criminal petition. 6.
In light of the submissions made by both the learned counsel and upon a perusal of the material available on record, it is evident that the petitioner has been arrayed as Accused No.4 and even as per the remand report, it is noted that the petitioner was working under Accused No.5, who has already been granted bail. Considering the overall facts and circumstances of the case, including the nature of the allegations, the stage of investigation, and the duration of incarceration, this Court finds it appropriate to grant bail to the petitioner, subject to the following conditions:

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned Additional Judicial First Class Magistrate at Gajwel, Siddipet District.
ii.
The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
iii.
The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
