SMT JUSTICE T.RAJANI CRIMINAL PETITION No.11231 OF 2018 ORDER:

This Criminal Petition, under Section 482 of Cr.P.C., is filed by the Petitioner/A-3 seeking to quash the proceedings in C.C. No.210 of 2016, pending on the file of the Court of III Additional Junior Civil Judge, Guntur (for short, 'the trial Court'), registered for the offences punishable under Sections 120-B, 419, 420, 468 and 478 of I.P.C.

Heard the learned counsel for the petitioner and learned Public Prosecutor, appearing for the 2nd respondent - State. 3.

Learned counsel for the petitioner does not press upon the other grounds mentioned in the Petition and he only seeks that a direction be given to the trial Court not to insist the presence of the petitioner. 4.

Learned counsel further submits that the Court is III Additional Junior Civil Judge but it was wrongly mentioned in the Petition as IV Additional Junior Civil Judge.

Hence, considering the above, this Court opines that the presence of the petitioner before the trial Court may not be insisted upon, unless it is required for the proceedings of the case. Accordingly, the presence of the Petitioner/A-3 shall be dispensed with. But, however, the trial Court can direct the Petitioner/A-3 to be present on those dates of the proceedings in which his presence is required. 6.

Accordingly, with the above direction, the Criminal Petition is disposed of. 7.

As a sequel, miscellaneous petitions if any, pending in this Petition shall stand closed.
