SMT. JUSTICE T.RAJANI CRIMINAL PETITION No.3413 of 2013 ORDER:

This criminal petition is filed under Section 482 Cr.P.C., seeking to quash the proceedings in S.T.C.No.5 of 2007 on the file of Judicial First Class Magistrate, Penukonda, Anantapuram District, registered for the offence under Section 7(i) and 2(ia)(k) punishable under Section 16(1-A)(i) of Prevention of Food Adulteration Act, 1954, against the petitioner/A1.

Heard learned counsel for the petitioner and learned Public Prosecutor for the respondent-State.

Learned counsel for the petitioner submits that this Court, by virtue of the order dated 23.09.2015 passed in Crl.P.No.13082 of 2011, quashed the proceedings against A3 and A4 in the aforesaid case and that as the petitioner/A1 also stands on the same footing, the proceedings against him are liable to be quashed. 4.

Considering the said submission and by virtue of the order dated 23.09.2015 passed in Crl.P.No.13082 of 2011, further proceedings against the petitioner/A1 are quashed. 5.

Accordingly, the Criminal Petition is allowed, quashing the proceedings in S.T.C.No.5 of 2007 on the file of Judicial First Class Magistrate, Penukonda, Anantapuram District, against the petitioner/A1. Miscellaneous applications, if any, pending in this criminal petition shall stand closed.
