THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.24216 OF 2015 ORDER:

Heard.

The petitioner states that he made an application for grant of pattadar passbooks and title deeds under Form VI-A of the Andhra Pradesh Rights in Land and Pattadar Passbooks Act, 1971 (for short, 'the Act') vide his application, dated 17.07.2014, to the Tahsildar, Tadepalligudem Mandal, West Godavari District, the 2nd respondent, with regard to the lands admeasuring Ac.1.18 cents in R.S.No.296/3 and Ac.0.67 cents in R.S.No.274/3 of Jagganapeta Vilalge of Tadepalligudem Mandal. The petitioner states that no order is passed on the said application and when the petitioner made an application under the Right to Information Act, he had been given information by an endorsement, dated 04.02.2015, wherein it is stated that the petitioner's application under Form VI-A of the Act is rejected. However, as no orders have been passed by the 2nd respondent on the said application in terms of the Act, the petitioner is disabled from questioning the said rejection before appropriate forum.

It appears from the record that on the application filed by the petitioner under the Right to Information Act, the 2nd respondent gave endorsement that the petitioner's application, dated 17.07.2014, was rejected.

Hence, the Writ Petition is disposed of directing the 2nd respondent that if order is already passed on the petitioner's application under Form VI-A of the Act, the same shall be communicated to the petitioner and if no such order is passed so far, the 2nd respondent shall forthwith pass appropriate orders and communicate the same to the petitioner. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
