THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.1286 OF 2016 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

The petitioner seeks rectification of entries in pahanies with regard to Survey No.937/A at Raikal Village and Mandal, Karimnagar District. An application, dated 24.08.2015, was made by the petitioner before the Revenue Divisional Officer, Jagtial Revenue Division, Karimnagar, the 3rd respondent, which is stated to be numbered as File No.J/8912/2015. The present Writ Petition is filed alleging inaction on the part of the 3rd respondent.

It is however evident from the record that the petitioner has not made any application before the recording authority under the Andhra Pradesh/Telangana State Rights in Land and Pattadar Pass Books Act, 1971 (for short, 'the Act'). Hence, no relief as sought for by the petitioner can be granted.

The Writ Petition is accordingly disposed of giving liberty to the petitioner to make appropriate application before the recording authority under the Act. While complying with the requirements under the Act and Rules framed thereunder, if such application is filed by the petitioner, the 4th respondent shall consider the same on its own merits and pass appropriate orders in accordance with law expeditiously. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
