THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.4223 OF 2002 ORDER:

This petition is filed for a writ of 'Certiorari' calling for the records from the 1st respondent and to quash the order dated 08.02.2002 passed by the 1st respondent as illegal and arbitrary. Heard learned counsel for the petitioner and Sri J.Sreenivasa Rao, learned Standing Counsel for Singareni Collieries appearing for the 2nd respondent.

This Court on 29.12.2010 passed the following order; "Learned counsel for the petitioner is permitted to take steps to bring the L.Rs. of the deceased respondent No.2 within six weeks. If for any reason, the steps are not taken, the same shall be brought to the notice of the Registry without fail. In default, the case against the deceased respondent No.2 shall stand abated without reference to the Court."

Since the steps were not taken by the petitioner, the order passed on 29.12.2010 given effect to and an office endorsement to that effect is also made. The writ petitioner challenged the order dated 08.02.2002, passed by the 1st respondent in favour of the 2nd respondent. Since the writ petition was dismissed against the 2nd respondent in whose favour the impugned order has been passed, no relief can be granted against the 1st respondent. In view of the same, the writ petition stands dismissed. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
