HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.17155 OF 2016 ORDER:

The case of the petitioner is that his father purchased land to an extent of Ac.04-20 cents in Sy.No.287/B of Paipadu Village of Waddepally Mandal, Mahabubnagar District under registered sale deed dated 04-05-1965 and his father expired on 20-08-2007 leaving behind him and his brothers namely Chakali Meenappa, Chakali Madanna,Chakali Chinna Madanna and Venkateshwarlu. It is further averred that the petitioner and his brothers are in continuous possession and enjoyment of the said property and they made several representations from 2007 onwards and finally on 24-04-2012, 19-05-2012 and on 04-02-2013 to the 2nd and 3rd respondents for grant of mutation in respect of the subject land and issuance of pattadar passbooks and Title deeds in their favour. As no action has been taken, the present writ petition is filed.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue, who submits that the petitioner along with his brothers have not made proper application under Form-VI (A) of the A.P.Rights in Land and Pattadar Passbooks Act,1971 in respect of their grievance. Learned counsel for the petitioner submits that the petitioner will make application in proper format as per rules.

In view of the same, it is open for the petitioner to make application as per rules within a period of three weeks from today and on such application, the 3rd respondent is directed to dispose of the same, in accordance with law, within a period of two months thereafter.

With the above observation, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
