THE HON'BLE SMT JUSTICE KONGARA VIJAYA LAKSHMI CIVIL REVISION PETITION No.875 OF 2013 O R D E R:

The civil revision petition is filed questioning the order dated 28.12.2012, passed by the Senior Civil Judge, Gurazala, Guntur District in C.M.A.No.9 of 2012 whereby confirming the order dated 03.10.2012 passed by the Junior Civil Judge, Gurazala, Guntur District in I.A.No.319 of 2012 in O.S.No.140 of 2012.

The C.M.A.No.9 of 2012 was filed by the petitioner/plaintiff before the Senior Civil Judge, Gurazala questioning the order dated 03.10.2012, passed by the Junior Civil Judge, Gurazala, Guntur District in I.A.No.319 of 2012 in O.S.No.140 of 2012 and the said C.M.A was dismissed on 28.12.2012 confirming the order of the trial Court. Today, when the matter is taken up for hearing, learned counsel for the revision petitioner submitted that the suit is still pending and that there was no stay granted by this Court in the present civil revision petition and requested this Court to direct the trial Court to dispose of the main suit itself by fixing some time. Learned counsel for the respondent does not raise any objections for the said proposal.

In view of the submission made by the learned counsel for the petitioner, the civil revision petition is disposed of directing the Junior Civil Judge, Gurazala, Guntur District to dispose of the suit in O.S.No.140 of 2012, as expeditiously as possible, preferably within a period of three months from the date of receipt of a copy of the order. No order as to costs.

Consequently, the miscellaneous Applications, if any shall stand closed.
