Heard.
The petitioner has made an application seeking conversion of agricultural land to non-agricultural purpose with regard to Survey Nos.221 and 222 by approaching the 2nd respondent on 29.10.2015. The 2nd respondent has passed order dated 08.01.2016 under Ex.P.4, permitting conversion, as sought for, by the petitioner for Survey No.221. However, the order does not speak about Survey No.222. The petitioner, therefore, seeks a direction to the 2nd respondent to pass appropriate orders with regard to Survey No.222. The petitioner asked for conversion of agricultural land to nonagricultural land with regard to two survey numbers, but permission was granted only for Survey No.221 and deemed to be rejected for Survey No.222. If the petitioner is aggrieved by the rejection of permission with regard to Survey No.222, in such scenario, she must approach the appellate authority to agitate non-consideration of her claim with regard to Survey No.222.
I do not see any reason to entertain this writ petition once again seeking direction to the 2nd respondent with regard to the said survey number. Since the order of conversion passed by the 2nd respondent is dated 08.01.2016, the limitation available for filing appeal has already been expired. Hence, as requested by the learned counsel for the petitioner, two weeks time is granted from today to prefer an appeal. If the appeal is accordingly preferred, it shall be entertained by the appropriate authority without raising any question as to limitation. With the above observations, the writ petition is disposed of. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in the writ petition shall stand closed.
