ORDER
Heard learned counsel appearing for the petitioner and learned Government Pleader for Civil Supplies appearing for respondents 1 to 4.
This writ petition is filed seeking to declare the action of the 4th respondent in not releasing the essential commodities to the fair price shop of the petitioner, as arbitrary and illegal. The petitioner was appointed as a fair price shop dealer on permanent basis. His authorization was renewed on the basis of the challan submitted by him on 13.3.2015 and in view of the same, the essential commodities have been released. However, the petitioner submitted demand draft dated 18.3.2015 to the 4th respondent for release of the stock for the month of April, 2015. In spite of receiving the same, the respondents have not released the stock. Hence, the present writ petition has been filed.
Learned counsel appearing for the petitioner submits that the authorization of the petitioner was neither suspended nor cancelled. He further submits that though the authorization of the petitioner was renewed based on the challan submitted by him, the respondent authorities are not supplying the essential commodities.
Though the learned Government Pleader for Civil Supplies was given time for getting instructions, so far no instructions have been received.
In the circumstances, the Writ Petition is disposed of
directing the 3rd respondent to release the stock to the petitioner to enable him to supply essential commodities to the card holders, if no proceedings are pending against him and the authorization was not suspended as on today. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
