Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed herein, the High Court may be pleased to issue a writ order or direction more particularly in the nature of writ of mandamus declaring the illegal action of the respondents 3 to 6 in tender Notice IFBNo. 5,6,10,11,13,15,16/2014-15 dt.3-02-2015 and IFBNo24/2014-15 dt.
1202-2015 for the works of Minor Irrigation - Adilabad district- Mission Kakatiya, illegal arbitrary and violation of articles 14 and 19 of the Constitution of India and consequently direct the respondents to accept the tender Schedule of the petitioner by entering into the agreement and allowing to execute the works in case of becoming successful bidder by setting aside the agreement entered with respondents 3 to 6 in tender Notice IFBNo.5,6,10,11,13,15,16/2014-15 dt.302-2015 and IFB No. 24/2014-15 dt.12-02-2015 for the works of Minor Irrigation-Adilabad district-Mission Kakatiya. The petition coming on for hearing, upon perusing the Petition and the affidavit filed in support thereof and upon hearing the arguments of Sri Kuna Reddy Anji Reddy, Advocate for the Petitioner and GP for Irrigation (TG) for Respondent Nos.
Learned Government Pleader seeks time to get instructions.
Post this Writ Petition along with W.P.Nos.5845, 6671 and 13365 of 2015 on 27.07.2015 "for orders".
In the meanwhile, if the works were not awarded, the same shall not be awarded in respect of tender notice Nos.10, 11 and 13/2014-15 till 27.07.2015.
