The case of the petitioner is that she made representation, dated 18-12-2007, for allotment of land admeasuring Ac.01-30 guntas situated in Sy.No.214 of Kanchanapally Village of Valigonda Mandal, Nalgonda District stating that she is cultivating the same for the last 30 years and for grant of patta certificate in her favour in respect of said land.
Learned Assistant Government Pleader for Revenue produced written instructions stating that the petitioner and her husband holding more than 6 acres of land and in the year 2013, the husband petitioner gifted two acres of land to his daughter through gift settlement deed. At present the petitioner and her husband is having Ac.0426 guntas of patta land. The petitioner has occupied government land to an extent of Ac.0-15 guntas and already an extent of Ac.1-10 guntas of government land is being utilized for community purpose and the villagers have approached for assignment of the same. The petitioner does not belong to landless poor persons category, as her family is having Ac.04-26 guntas. Since the petitioner has not stated what is her legal right for allotment of land and more so, the written instructions
produced by Assistant Governemnt Pleader stating that her husband is having Ac.04-26 guntas and Ac.2-00 guntas was gifted in favour of his daughter, no mandamus can be issued to the respondents for grant of patta to the petitioner.
Therefore, I am not inclined to entertain the writ petition and accordingly, the same is dismissed. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 01-09-2016 Nvl
