THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.38366 OF 2018 ORDER :

Heard learned counsel for the petitioner and the learned Government Pleader for Home, apart from perusing the entire material on record.

When the matter is taken up, written instructions, dated 24.10.2018, furnished by the Sub Inspector of Police, Inugudurupeta Police Station, Krishna District, are placed on record by the learned Government Pleader. The said instructions, to the extent of their relevance to the present Writ Petition, read as under:

"It is submitted that the respondent No.4 Station House Officer, Inugudurupeta Police Station, Krishna District had received the petitioner's representation dated 29.09.2018 through the Sub Divisional Police Officer. Machilipatnam for enquiry and necessary action vide C.No.191/Prajadivas/SDO-M/2018 dated 05.10.2018. In the said representation the petitioner stated that he belongs to Tamil Nadu State and he has taken rented premises baring No.

5/371/2, situated at Fathullabad, Machilipatnam. Krishna District from its owner. He is doing business of electrical, furniture and steel under the name and style of AGNI traders. The petitioner further stated that he selling the home appliances on reasonable rates and there is an apprehension from other businessmen, he requested to provide police protection to him. It is submitted that the 4th respondent enquired into the representation of the petitioner nut revealed that as of now, the petitioner did not started the business in the above said rented premises. However, the 4th respondent will provide protection to the petitioner as per his need arises with due process of law. In this connection the same was informed to the petitioner.

It is submitted that tilt contention of the petitioner that the respondent No. 4 Station House Officer, Inugudurupeta Police Station, Krishna District harassed and interfered with the business activities of the petitioner traders running in the above said rented premises baring No.5/371/2, situated at Fathullabad, Machilipatnam, Krishna District is

incorrect, baseless, far from truth and has been created for the purpose of filing the present Writ Petition. It is submitted that it is incorrect to say that the respondents 3 and 4 came to the petitioner business premises and demanded money or else the petitioner will be implicated in false cases, hence denied.

It is also incorrect to say that the police informed the petitioner that without paying bribe, the petitioner cannot be permitted to do the said business in the locality, hence denied.

It is submitted that except receipt of the above said representation of the petitioner, the 4'1' respondent did not harass or interfere with the business activities at and point of time as alleged by the petitioner.

It is vital to submit here that, when the petitioner did not start his business at the said rented house, the question of harassing or interfering does not arise".

By placing on record the above written instructions, Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions pending, if any, shall stand closed. __________________ A.V.SESHA SAI, J 25th October, 2018 Tsy
