THE HONOURABLE Dr.JUSTICE B.SIVA SANKARA RAO I.A.Nos.1 and 2 of 2018 in/and Criminal Petition No.11314 of 2018 ORDER :
The 2nd respondent is the defacto-complainant of Cr.No.153 of 2015 of Kanchikacherla Police Station, registered for offence punishable u/ sec. 307IPC covered by PRC No.61 of 2015 on the file of the Judl.Magistrate of First Class, Nandigama and S.C.No.412 of 2015 on the file of the Asst.Sessions Judge, Nandigama, where the trial Court by judgment dt.17.11.2016 convicted the two accused/ petitioners herein to undergo Simple Imprisonment for three years with a fine of Rs.2,000/ - each with default sentence of six months. Aggrieved thereby both the accused maintained Crl.A.No.338 of 2016 on the file of the XVI Addl.Sessions Judge, Nandigama. It is at this stage, both the accused and the defactocomplainant appeared before the Court and seeking to compound the offence. It is their say that wife of the defacto-complainant is no other than mother of the A.1 by virtue of the subsequent events and marriage, to purchase peace, they settled the matter amicably through elders.
Having regard to the above, I.A.No.2 of 2018 by permitting the parties to compromise and I.A.No.1 of 2018 by compounding the offence supra are allowed. Consequently, the Criminal Petition is allowed by quashing the proceedings in Crl.A.No.338 of 2016 on the file of the XVI Addl. Sessions Judge, at Nandigama by setting aside the trial Court's conviction judgment in S.C.No.412 of 2015 on the file of
the Asst.Sessions Judge, Nandigama. The accused are acquitted and their bail bonds shall stand cancelled. Pending miscellaneous petitions, if any, shall stand closed.
