THE HON'BLE SRI JUSTICE S.V. BHATT W.P No.11712 of 2013 ORDER:

Heard learned counsel for the petitioner and learned Assistant Solicitor General.

The petitioner was called upon to obtain a declaration from competent civil Court for effecting change of date of birth. The learned counsel for petitioner fairly states that the issue in the writ petition is covered against him in the decision reported in Syed Thaihseen Hussain v. Passport Officer, Regional Passport Office, Hyderabad[1]. According to ratio laid down in the said decision, the person has to move competent civil Court and then request for correction or change of date of date of birth. By giving liberty to the petitioner to avail the remedies in a properly instituted suit before competent Court, the writ petition is disposed of. No order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
