HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.42319 OF 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking to declare the inaction of the 2nd respondent in passing orders in the appeal filed by the petitioner on 12.01.2016, as illegal and arbitrary. Heard the learned counsel for the petitioner as well as the learned Assistant Government Pleader for Revenue for respondents. With their consent, the writ petition is disposed of at the stage of admission itself.

The case of the petitioner is that on 04.12.2015 he made an application before the 3rd respondent under Right to Information Act, 2005 (for short 'the Act') to know as to whether the ryotwari pattas, mentioned in the said application, was cancelled or not. Since the 3rd respondent failed to dispose of the application of the petitioner within the stipulated period of 30 days as contemplated u/s.7(1) of the Act, petitioner filed an appeal before the 2nd respondent on 12.01.2016. Since no orders are passed in the said appeal, present writ petition is filed.

Learned AGP would submit that since the appeal is filed in the month of January, 2016, a suitable direction may be given to the 2nd respondent to dispose of the appeal, in accordance with law.

Having considered the rival submissions made, the writ petition is disposed of directing the 2nd respondent-The District Revenue Officer-cum-Appellate Authority under RTI Act, Chittoor, to dispose of the appeal filed by the petitioner on 12.01.2016, in accordance with law, as early as possible, preferably within a period of eight weeks from the date of receipt of a copy of this order.

Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No order as to costs.
