HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.38549 OF 2018 ORDER :

This writ petition is filed challenging the action of the 5th respondent in threatening to dispossess the petitioners from the lands assigned to them in Sy.No.266/3 to an extent of Ac.2.00 cents, Sy.No.266/14 to an extent of Ac.1.50 cents and Sy.No.266/15 to an extent of Ac.1.23 cents, situated in Nissankadurgam Village of Surendranagaram Group, Karvetinagar Mandal, Chittoor District.

Learned counsel for the petitioners submits that against the orders passed by the Joint Collector dated 16.09.2017 in D.Dis.(E4)/5147/2009, petitioners filed appeal before the 2nd respondent along with stay petition on 29.11.2017, and in the meanwhile the 5th respondent is trying to evict the petitioners from the subject land.

Heard learned Assistant Government Pleader for Revenue.

Since it is stated that statutory appeal is pending before the 2nd respondent, it is for the 2nd respondent to consider the same on merits of the case.

In view of the same, the 2nd respondent is directed to dispose of the stay petition or appeal as expeditiously as possible, in accordance with law. Till disposal of the

stay/appeal, there shall be interim stay of dispossession. No order as to costs.
