THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.2818 of 2015 ORDER:

Upon hearing both sides, at the admission stage, the following Order is passed:

As can be seen from the complaint allegations, on a promise and inducement of accused No.1, the complainant has deposited amounts in the accounts of Accused Nos. 2 and 3 with the hope that A.1 to A.3 procure a medical seat to his daughter. Later, he was cheated by them. The investigation is reported to be pending.

Having regard to the prima facie accusation contained in the FIR, it is not a fit case to quash the proceedings. Hence, the investigation shall be taken up to unearth the role of the petitioner and other accused in the entire episode. Therefore, the Police of Miyapur Police Station, Cyderabad, are directed to complete the investigation expeditiously and file the final report. However, the Police are directed to strictly follow the procedure contemplated under Section 41-A Cr.P.C. during the course of investigation towards the petitioner/A.1. The petitioner shall cooperate with the investigating agency for smooth completion of investigation. With the above observation, the Criminal Petition is disposed of.
