HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:
Petitioner alleges that his motor cycle bearing registration No.TS-26-0233 was seized on the allegation of committing violation of the provisions of the A.P. Prohibition Act, 1995. The averments made in the affidavit filed in support of the writ petition do not disclose that petitioner filed an application before the Deputy Commissioner praying for release of vehicle. No writ petition can be entertained directly without first approaching the competent authority and asking for release of the vehicle. 2.
The writ petition is disposed of, granting liberty to the petitioner to file an application before the jurisdictional Deputy Commissioner praying to release his vehicle by way of interim custody. As and when such application is filed, the Deputy Commissioner shall consider the same and pass appropriate orders within a period of one week from the date of receipt of copy of such application. It is open to the Deputy Commissioner to impose such conditions as required while granting permission to release the vehicle.
