HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37009 of 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking quash the proceedings against him in FIR No.1073 of 2015 on the file of Uppal Police Station, Ranga Reddy District. 2.

Heard and perused the material available on record. 3.

It is the case of the petitioner that one Bathula Ravikiran involved in many cases and he is alleged to have confessed in a case in Crime No.188 of 2016 that some theft articles were mortgaged with the petitioner and on the basis of the same, the petitioner was shown as A4 in that crime and now, the police are trying to arrest the petitioner on the ground that ear studs alleged to have been stolen by Bathula Ravikiran in Crime No.1073 of 2015 are mortgaged with the petitioner. It is the grievance of the petitioner that his name was not mentioned in Crime No.1073 of 2015. But the police are trying to arrest him.

Considering the facts and circumstances of the case and the grievance of the petitioner, without expressing any opinion, this Court is inclined to pass the following order:

"The petitioner is directed to surrender before the Court concerned and file bail application. On such surrender and on such application being filed, the Court concerned is directed to release the petitioner on the same day on his executing a personal bond for a sum of Rs.5,000/- (Rupees Five Thousand only) with one surety for the like sum to the satisfaction of the Court concerned. The petitioner is directed to report before the Station House Officer concerned daily in between 10 a.m., and 5 p.m., for a period of 15 days."

With the above direction, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed. ________________ RAJA ELANGO, J Date: 15th November, 2016 Nn
