Heard Mr. Kapuluru Sai Varun, learned counsel appearing for the applicant and Mr. Laxman Rao, learned counsel appearing for respondent Nos.1 to 5 and 7.

By order dated 02.04.2026, this Court proposed to appoint Sri C. Hare Krishna Bhupathi, retired District Judge, as an independent Arbitrator to adjudicate the dispute between the parties. The order dated 02.04.2026 is extracted hereunder for easy reference:

"Mr. Kapuluru Sai Varun, learned counsel appears for the applicant. The parties have entered into a Partnership Deed dated 29.12.2018. In respect of the disputes arose between them, the applicant has invoked arbitration clause 15 and issued notice dated 12.09.2025 upon the respondents for appointment of an arbitrator. Despite service of notice, no reply has been given by the respondent. Therefore, the applicant has approached this Court for appointment of an independent arbitrator under Section 11 (5) and (6) of the Arbitration and Conciliation Act, 1996.

Respondents No.1 to 5 and 7 have entered appearance through Mr. M.Laxman Rao, learned counsel, who submits that he has no objection for appointment of an independent arbitrator as proposed by the applicant i.e., Mr. C.Hare Krishna Bhupathi, retired District Judge. Learned counsel, however, has not made any comments on the merits of the matter, which are left open to be taken in the arbitration proceedings. Both the learned counsel agree for appointment of a sole arbitrator instead of a panel of three arbitrators as per Clause 15 of the Partnership Deed dated 29.12.2018. In view of the consensus arrived between the parties,I hereby propose to appoint Mr. C.Hare Krishna Bhupathi, retired District Judge (R/o.Flat No.203, Laxmi Residency, Road No.

9, New Nagole Colony, lane by the side of Union Bank of India, Nagole Branch; Mobile No: 9573889969), as an independent Arbitrator to adjudicate the dispute between the parties. The proposed Arbitrator is requested to submit his consent and declaration in terms of Section 12(1) read with Schedule VI of the Arbitration and Conciliation Act, 1996. Registry is directed to communicate this order to the proposed Arbitrator. The matter be listed after three weeks with the response, if any, of the proposed Arbitrator."

The proposed Arbitrator has submitted his consent along with a declaration under Section 12(1) read with Schedule VI of the Arbitration and Conciliation Act, 1996 (for short, 'the Act') by letter dated 13.04.2026. 4.

Learned counsel for the applicant, therefore, submits that appointment of the proposed Arbitrator may be confirmed.

In that view of the matter, I hereby appoint Sri C. Hare Krishna Bhupathi, retired District Judge (R/o. Flat No.203, Laxmi Residency, Road

No.9, New Nagole Colony, lane by the side of Union Bank of India, Nagole Branch; Mobile No: 9573889969), to act as an independent Arbitrator in respect of the dispute between the parties.

Registry is directed to serve a xerox copy of the entire pleadings to the learned Arbitrator. The learned Arbitrator is requested to keep in mind the fee prescribed in Schedule IV of the Act and the time limit prescribed under Section 29A of the Act.
