THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.1802 OF 2016 ORDER:

The grievance of the petitioner was that the mining authorities were not acting in accordance with law and were interfering with his activity in removing the excavated silica sand as per the order passed by this Court on 01.12.2015 in W.P.M.P.No.29302 of 2015 in W.P.No.22679 of 2015.

Written instructions were furnished by the Assistant Director of Mines and Geology, Nellore, to the office of the learned Government Pleader for Mines and Geology stating that in pursuance to the afore-stated order passed by this Court, the mining authorities were issuing dispatch permits for the balance quantities which were to be removed as per the direction of the National Green Tribunal in its order dated 07.09.2015. The Assistant Director further stated that his office was not interfering with the activities of the petitioner. The afore-stated stand of the Assistant Director of Mines and Geology, Nellore, is taken on record. In the light thereof, the allegation of the petitioner that the mining authorities were interfering with the removal of the excavated silica sand stands disproved. The mining authorities shall abide by the stand taken by them before this Court. The writ petition is accordingly closed. Pending miscellaneous petitions, if any, shall also stand closed.
