HON'BLE SRI JUSTICE R.KANTHA RAO W.P.No.16033 of 2015 ORDER:

Heard learned counsel appearing for the petitioner, learned Government Pleader for Revenue appearing for respondents 1 and 2 and learned Government Pleader for Panchayat Raj appearing for respondents 3 and 4. This writ petition is filed seeking to declare the action of the 4th respondent in placing the petitioner under suspension vide proceedings dated 3.7.2014 without conducting any enquiry, as arbitrary and illegal.

The petitioner was appointed as Field Assistant in District Water Management Agency, Doddupalem, Visakhapatnam District, in 2008. Based on certain irregularities which include misappropriation of funds, show cause notice was issued to the petitioner, for which, he submitted his explanation. Thereafter, the impugned suspension order was passed.

The grievance of the petitioner is that though the suspension order was passed on 3.7.2014, no enquiry has been initiated against him so far.

On the other hand, learned Government Pleader submits that the enquiry is going to be completed shortly.

Under these circumstances, the Writ Petition is disposed of directing the 4th respondent-Project Director and Joint Secretary to complete enquiry and pass final orders within a period of two weeks from the date of receipt of a copy of this order, failing which, the impugned suspension order shall stand revoked. There shall be no order as to costs. The Miscellaneous Petitions, if any, pending in this writ petition stand closed.
