This Criminal Petition is filed under section 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short' BNSS') seeking the Court to enlarge the petitioners on bail who are arrayed as accused Nos.3 and 4 in Crime No.1176 of 2025 of Dundigal Police Station, Cyberabad Commissionerate, registered for the offences punishable under Section 109 r/w.3(5) of Bharatiya Nyaya Sanhita, 2023.

The case of the prosecution is that the defacto complainant lodged a complaint before police on 02.12.2025 stating that there are land disputes between the victim and accused and all the accused went to the victim, asked for share in the land, threatened the victim to kill him and beat him with centering stick. As such, requested the police to take action against the accused basing on which police registered the case against the accused for the above offence. 3.

Heard Sri Jula Sandeep Kumar, learned counsel for petitioners and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for respondent - State.

The contention of learned counsel for the petitioners is that the petitioners are innocent of the allegations and have been falsely implicated in this case. There are land disputes between the parties. In fact, the petitioners suffered injuries at the hands of the victim, and instead of registering the case reported by the petitioners, they were implicated in this matter under the influence of the victim. Further entire investigation is completed, as such, prayed this Court to grant regular bail to the petitioners.

On the other hand, the learned Additional Public Prosecutor opposed bail stating that the alleged offence against the petitioners is under Section 109 of BNS which is a serious offence. However, he reported the Court that the entire investigation is completed and charge sheet is filed. Hence, prayed this Court to dismiss this petition. 6.

Considering the submissions made by both the counsel and material on record, the petitioners are in jail from 03.12.2025 and as seen from the remand report, victim sustained abrasion which is a simple injury and according to the Additional Public Prosecutor, investigation is completed and charge sheet is also filed, as such further custodial interrogation of the petitioners is not required. Hence, this Court deems it appropriate to grant bail to the petitioners subject to the following conditions.

i. The petitioners/A.3 & A.4 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties for a like sum each to the satisfaction of the VIII-Additional Judicial Magistrate of First Class at Medchal, Cyberabad.

ii. The petitioners/A.3 & A.4 shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the

purpose of investigation, and thereafter, as and when required.

iii. The petitioners/A.3 & A.4 shall abide by the conditions stipulated in Section 483(2) of the BNSS.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
