Heard learned counsel for the petitioner and learned Standing Counsel for the respondents.

Petitioner claims to have owned Goods Transport Vehicles for transporting Scheduled Commodities and Essential Commodities from Godown to the respondent Marketing Federation to distribution point. He used to participate in the tenders called by the Government Organizations, such as Food Corporation of India, Civil Supplies Corporation and MARKFED etc. Petitioner claims that without calling for tenders, on 12.10.2018 contract was awarded to a third person and the same is illegal. Therefore, he seeks a declaration that the order dated 12.10.2018 hading over the transportation of Maize to Dhanalakshmi Transports, Vikarabad, represented by its Proprietor Sri Balvanth Reddy, as illegal.

The prayer sought is vague and the person in whose favour the contract was awarded is not made a party. Copy of the alleged contract is not filed. Even assuming that what is contended by petitioner is true, petitioner cannot straight away rush to this Court by filing Writ Petition under Article 226 of the Constitution of India without obtaining relevant information from the competent authority to ascertain the true facts and pointing out illegality in the process adapted to award contract.

The Writ Petition is accordingly dismissed leaving it open to the petitioner to work out his remedies as available in law. Pending Miscellaneous Petitions, if any, shall stand closed. ____________________ P. NAVEEN RAO, J Date:29.10.2018 KH
