HON'BLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.37814 of 2016 ORDER:

When the matter was called in the morning session, there was no representation on behalf of the petitioner. The matter was passed over. Even in the afternoon session, there is no representation.

Learned standing counsel for the 2nd respondent Municipality is present.

On 17.04.2018, Sri K. Subramanyam, learned counsel for the petitioner, informed this Court that the petitioner has taken away the bundle from him long back i.e., in the year 2016 itself and he has no instructions. Therefore, this Court directed the office to print the name of the petitioner and post the writ petition on 20.04.2018. On 20.04.2018, as there was no representation on behalf of the petitioner, the mater was adjourned and posted to 24.04.2018 under the caption "for orders". Even on 24.04.2018 there is no representation. However, to give one more opportunity to the petitioner, the matter was posted to today. Even today also there is no representation.

Though the petitioner has taken away his bundle from his counsel in the year 2016 itself, he did not choose to appear either in-person or he engaged any counsel. From this it is evident that he is not interested to prosecute the matter.

The writ petition is, therefore, dismissed for nonprosecution. No order as to costs. Miscellaneous petitions, if any, shall also stand dismissed.
