HON'BLE SRI JUSTI CE C. PRAVEEN KUMAR WRIT PETITION No. 38430 of 2018 ORDER:

1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in demolishing the wall constructed in the private land of the petitioner situated in Sy.No.723/ Part and 724/ Part of Korremula Village, Ghatkesar Mandal, Ranga Reddy District, as illegal, arbitrary and incorrect.

2) At the time when the matter is taken up for hearing, learned counsel for the petitioner would submit that without any notice action is being taken to remove the compound wall.

3) The learned Standing Counsel for H.M.D.A. would submit that a notice was issued on 15.06.2018 and thereafter an order dated 20.10.2018 came to be passed by H.M.D.A., for removal of the obstruction.

4) Since the grievance of the petitioner is that no notice was given to him and that there is no material on record to show that notice has been served on him, treating the notice dated 15.06.2018 as a show-cause notice, the writ petition is disposed of directing the petitioner herein to submit his explanation to the notice dated 15.06.2018 within a week

from today, in which event, the authorities concerned shall pass orders in accordance with law, after hearing all the concerned, at the earliest. Till such time status quo as on today shall be maintained.

5) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs.
