THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.31390 of 2015 ORDER :

The petitioner is aggrieved by the application submitted by 3rd respondent for grant of building permission to construct multi storied building in Sy.No.1032/2B, Ramnagar, Division No.19, Visakhapatnam. The petitioner challenges the endorsement dated 15.04.2015 where under, after scrutiny of the building permission application of 3rd respondent, she was asked to pay the fee required and other requirements to be fulfilled and was directed to comply with. The petitioner challenges the very endorsement of building permission application submitted by the 3rd respondent.

2. When the matter is taken up for consideration, learned Standing counsel representing the respondentCorporation, submits that by endorsement in B.A.No.14880/2015/ACP-III dated 21.09.2015, the building permission application of the 3rd respondent was returned as unapproved. Therefore, the cause in the writ petition does not survive.

3. Having regard to the same, the Writ Petition is dismissed as infructuous. However, it is left open to the petitioner to work out her remedies, if any fresh application is submitted by the 3rd respondent. There shall be no

order as to costs.
