HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.11287 of 2018 ORDER :

The petitioner is the accused in C.C.No.710 of 2012 on the file of the VI Additional Judicial Magistrate of First Class, Warangal, which is out come of a private complaint for the offence under Section 138 of the Negotiable Instruments Act, 1988.

The petitioner failed to attend the Court and non-bailable warrant was issued on 05.10.2015 and the same is pending. Instead of going to the trial Court by filing application for recall under Section 70(2) Cr.P.C., he moved the present criminal petition. There is nothing to consider, but for dispose of the criminal petition before admission and before issuing notice to the 2nd respondent, giving liberty to the petitioner to file an application under Section 70(2) Cr.P.C., before the learned trial Magistrate by appearance for consideration on same day on own merits.
