HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.38424 of 2018 ORDER :

This writ petition is filed challenging the action of the 2nd respondent in issuing Draft memo No.G2/19134/2011, dated 01.12.2011 and for a consequential direction to the respondents to receive and register the documents presented by the petitioners for registration in respect of the lands and buildings existed in Survey No.164/4, to an extent of 266.6 sq. yards of the 1st petitioner and to an extent of 44.4 sq.yards of 2nd petitioner of Podili Village and Mandal, Prakasam District without reference to the aforesaid Memo.

When the matter is taken up for hearing it is represented by the learned counsel for the petitioner that his Court in similar circumstances disposed of WP.No.39537/2015 and batch, vide order dated 07.12.2015.

In view of the same, and for the reasons alike, this writ petition is allowed setting aside the Memo No.G2/19134/2011, dated 01.12.2011, issued by the 2nd respondent. There shall be a consequential direction to the Sub-Registrar, Podili, to receive and process the documents presented by the petitioner in respect of the subject property without reference to the order dated 15.03.2011 of the High Court of Madras in Contempt Petition No.1205/2010. In the event, the documents presented are found to fulfill the requirements of the Registration Act,

1908 and the Indian Stamp Act, 1899, the Sub-Registrar, Podili, shall complete the registration formalities and release the documents, in accordance with due procedure.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. ____________________________ A.RAJASHEKER REDDY, J 25.10.2018 t k.
