This contempt case is filed alleging non-implementation of the order dated 05-09-2018 passed in IA No.1 of 2018 in WP No.31538 of 2018.

Notice was ordered in this contempt case on 09-11-2018. Pursuant to notice, counter affidavit is filed by the respondent. In the counter affidavit it is stated that the 2nd petitioner having entered into agreement with the respondent failed to engage the services of full time Nephrologists in all the three shifts to enable the ESIC hospital to refer the patients.

It is to be seen that the agreement itself is for providing the services of Nephrologists round the clock for the patients to be referred by the respondent-hospital. No reply affidavit is filed by the petitioners that they have appointed the Nephrologists as per the terms of the agreement entered into with the respondent. When once no Nephrologists appointed by the 2nd petitioner, the question of referring the patients to the 2nd petitioner does not arise. In the circumstances, prima facie, I do not find any violation of the interim order passed by this Court. The contempt case is accordingly closed. Miscellaneous petitions if any stand closed. No order as to costs.
