HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.38652 OF 2018 ORDER:

Heard counsel for petitioner, the Government Pleaders for Mines & Geology, Home and Revenue, appearing for the respondents. When the matter is taken up for hearing, learned Government Pleader for Mines and Geology, would submit that there is no violation of any provisions of Mines and Minerals or the Sand Policy, but, however, the vehicle bearing Nos.A.P.26TE 8380 and A.P. 26 TE 8381, came to be seized, as the petitioner was not having any proper documentation for claiming the same.

Having regard to the above, the writ petition is disposed of directing the petitioner to submit an application before the 3rd respondent-Deputy Transport Commissioner, seeking interim custody of the subject vehicles by enclosing the relevant documents, in which event, the 3rd respondent-Deputy Transport Commissioner, shall deal with the same and pass appropriate orders in accordance with law, as early as possible preferably within a period of one week from the date of submission of the application. No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
