THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.38449 OF 2018 ORDER:
When the matter is taken up for hearing, it is submitted by the learned counsel for petitioner that the petitioner has constructed a building as per the sanctioned plan and inspite of the same, the GHMC authorities are not coming and inspecting the premises and issuing occupancy certificate. Therefore, he contends that appropriate orders be passed in the writ petition directing the respondents to inspect the premises of the petitioner and upon being satisfied with the construction according to the sanctioned plan, further direct the respondents to issue the occupancy certificate.
Learned Standing counsel appearing for the respondentsGHMC contends that the officials of GHMC would inspect the building constructed by the petitioner and if the construction of building is in order, occupancy certificate would be issued to the petitioner within a reasonable period.
This Court, having considered the rival submissions of both the parties, is of the considered view that this writ petition can be disposed of directing the GHMC office to inspect the building constructed by the petitioner and if the building is constructed as per the sanctioned plan, issue occupancy certificate in favour of the petitioner.
The said exercise shall be completed within a period of eight (08) weeks from the date of receipt of a copy of this order.
With the above direction, this writ petition is disposed of. There shall be no order as to costs.
Miscellaneous Petitions, if any pending, shall stand closed.
